1. Agreement
By creating a TaxWise account, you ("you") enter into this agreement with TaxWise (Pvt) Ltd (Reg. No. PV 00307914), a company registered in Sri Lanka, having its registered office at 171/D35, Nelumpokunagama, Alawwa ("TaxWise", "we", "us").
2. The service
TaxWise is a software-as-a-service platform that helps individuals, partnerships and companies calculate tax liability, generate IRD schedules, and plan payments. You submit your return through the IRD e-Filing portal yourself.
TaxWise is a software tool. It is not a tax advisor, a chartered accountant, or an authorised representative of the IRD. You retain full responsibility for the accuracy of any information you provide and any return you submit.
3. Your account
- You must be 18 years or older and resident or filing in Sri Lanka.
- You must provide accurate identity information, including your NIC and TIN where required.
- You are responsible for safeguarding your password and any two-factor authentication device.
- You must notify us promptly at security@taxwise.lk of any unauthorised access.
4. Fees & refunds
Our pricing is listed at taxwise.lk/pricing and is denominated in Sri Lankan Rupees. Plus and Practitioner fees are payable when you start preparing a return for an assessment year or when your subscription renews. Fees are non-refundable once you have exported your schedules for that year. Before that point, you may request a full refund within 30 days of payment.
5. Your responsibilities
- To provide complete and accurate income, expense and relief information.
- To retain supporting documents for the seven-year statutory period.
- To review your schedules and submit your return through the IRD e-Filing portal.
- To pay any tax assessed by the IRD on the resulting return.
- Not to use TaxWise for fraudulent purposes or to evade Sri Lankan tax law.
6. Our role and disclaimer
We undertake to maintain TaxWise to a professional standard, to keep it aligned with the Inland Revenue Act and subsequent amendments, and to apply our calculations correctly to the data you supply. We do not guarantee any specific tax outcome. The legal relationship of taxpayer and Inland Revenue Department remains directly between you and the IRD.
7. Liability
To the maximum extent permitted by Sri Lankan law, TaxWise's aggregate liability arising out of or in connection with this agreement, whether in contract, tort, breach of statutory duty or otherwise, shall not exceed an amount equal to three times the fees you have paid us in the twelve months preceding the event giving rise to the claim, or LKR 50,000, whichever is the greater.
We exclude liability for any indirect, consequential or special loss; loss of profit; or loss of opportunity. Nothing in this clause limits our liability for fraud, willful misconduct, or anything else that cannot lawfully be excluded.
8. Termination
You may close your account at any time from within the application. We may suspend or terminate an account for material breach of these terms, including non-payment of fees, or where we are obliged to by Sri Lankan law. On termination, you retain access to download your prior filings for 30 days.
9. Governing law
These terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka. The courts of Colombo have exclusive jurisdiction over any dispute arising from this agreement.
